These Terms and Conditions ("Terms") govern your use of mox3.com and products operated by Zengy Inc. dba MOX3 ("MOX3", "we", "us"), including the CrewKap SMS program. By using the site or our services, you agree to these Terms. Client engagements may also be covered by a separate written agreement, which controls if it conflicts with these Terms.
1. CrewKap SMS Program
Program name: CrewKap Job Check-Ins
Description: CrewKap is a job management app for contractors, operated by MOX3. Workers who opt in receive text messages reminding them to check in on assigned jobs and confirming when their photo replies are received, for example: "CrewKap: Check in on 123 Main St. Reply with photo + area name." Workers reply by text or MMS with job-site photos. Messages are operational only. We do not send marketing messages through this program.
How to opt in: text START to the CrewKap number listed on our CrewKap SMS opt-in page. Consent to receive text messages is not a condition of employment, of any purchase, or of using CrewKap or any other MOX3 service.
Message frequency: varies based on your job schedule, typically up to a few messages per day on days you are assigned work.
Message and data rates may apply. Check your mobile plan for details.
Opt out: reply STOP to any message to stop receiving messages. You will receive one final message confirming you have been unsubscribed. To rejoin, text START again.

Carriers are not liable for delayed or undelivered messages. Delivery depends on your wireless carrier and device, and we do not guarantee that messages will be delivered or received on time.
Privacy: see our Privacy Policy. Mobile numbers and SMS consent are never shared with third parties or affiliates for marketing or promotional purposes.
2. Use of the Site and Services
You agree to use the site and services only for lawful purposes. You may not interfere with their operation, attempt to gain unauthorized access, or use them to send spam or unlawful content. Contractor companies using CrewKap are responsible for the accuracy of the worker information they enter and for having a lawful basis to add each worker.
3. Intellectual Property
Content on mox3.com, including text, graphics, logos, and code, is owned by MOX3 or its licensors and may not be copied or reused without permission, except as allowed by law.
4. Disclaimer of Warranties
The site and services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
5. Limitation of Liability
To the fullest extent permitted by law, MOX3 is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the site or services. Our total liability for any claim is limited to the amount you paid us for the service giving rise to the claim in the 12 months before the claim.
6. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Orange County, California.
7. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the site or services after changes means you accept the updated Terms.
